What to Do If You Are Falsely Accused of Domestic Violence

False or exaggerated allegations can still create real legal danger. Your response should be calm, documented, and strategic.

Reviewed for general legal information by Neil Panchal Law.

Do not confront the accuser

Even if the allegation is false, do not argue, threaten, repeatedly call, post about the case, or ask others to pressure the person. Those actions can be misinterpreted and may violate court orders.

Preserve helpful evidence

Save texts, emails, call logs, photos, videos, location records, receipts, witness names, and anything that shows the timeline. Do not alter messages or delete content. Screenshots can help, but original records may matter too.

Follow every protective order exactly

If there is a no-contact or stay-away order, follow it unless the court changes it. A violation can create a new charge and make the original allegation harder to defend.

When to call a defense lawyer

Call immediately if police contact you, a court date is set, a protective order exists, or your job, custody, housing, or license may be affected. Neil Panchal Law can help protect your rights and plan the next move.
